It is your obligation to examine the Terms of Use for any changes, and you are encouraged to do so on a regular basis. Your continued use of the website (http://www.inch.business/) (Website) or Applications (Inch, Inch-Online Construction Works) beyond the date that revisions to the Terms of Use take effect will constitute your assent to and acceptance of any new Terms of Use. Please do not use or access the applications if you do not agree to these or any subsequent Terms of Service.

THE SERVICES
Under the terms of this Agreement, Inch-Online Construction Works will provide you with the Services. The Services consist of the provision of a technological platform that allows you, as a user of Inch-Online Construction Works mobile application (each, an "Application") or Website, to: (a) arrange and schedule home-based services with independent associates of those services who have an agreement with Inch-Online Construction Works or its Associates; and (b) expedite payments to Associates for the services and receive receipts for those payments.
Unless Inch-Online Construction Works has agreed differently in a separate agreement, the Services are made accessible solely for your personal, non-commercial use. You acknowledge that Inch-Online Construction Works does not offer lame-based services and that all such home-based services are performed by associates of Inch-Online Construction Works. Under these Terms, Inch-Online Construction Works takes liability for the Services and the applications that it delivers to you. Associates are accountable for the services they deliver to you.
License
Subject to your compliance with these Terms, Inch-Online Construction Works grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable licence to: (i) access and use the Inch Platform on your personal device solely in connection with your use of the Services; and (ii) access and use any content, information, and related materials made available through the Services, all for your personal, non-commercial use. Any rights that are not expressly granted herein are reserved by Inch-Online Construction Works and its licensors.
Restrictions
You may not: (1) remove any copyright, trademark, or other proprietary notices from any portion of the Services; or (2) remove any copyright, trademark, or other proprietary notices from any portion of the Services: (1) except as specifically granted by Inch-Online Construction Works, reproduce, modify, create derivative works based on, distribute, licence, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast, or otherwise exploit the Services; (iv) create a link to, mirror, or frame any part of the Services;
Services and Content provided by Third Parties
The Services may be made available in conjunction with third-party services and content (including advertising) that are not within the control of Inch-Online Construction Works. You recognise that your use of such third-party services and content may be subject to other terms of service and privacy policies. Inch-Online Construction Works does not endorse such third-party services and material, and in no event shall Inch-Online Construction Works be responsible or accountable for any of such third-party providers' products or services.
YOUR USE OF SERVICES
User Accounts
To utilise the majority of the Services, you must first create and keep an active personal user Services account ("Account"). To open an Account, you must be at least 18 years old, or the age of legal majority in your country (if older than 18), unless a specific Service allows otherwise. Account registration necessitates the submission of personal information to Inch-Online Construction Works, such as your name, address, mobile phone number, and age.
In addition to at least one acceptable payment method (either a credit card or accepted payment partner). You must always give us with accurate, comprehensive, and up-to-date information. If you do not comply, you may be unable to access or use the Services. You are solely responsible for the security of the password you use to access the Service, as well as any activities or acts carried out under your password.
User Requirements and Behaviour
Persons under the age of 18 are not permitted to use the Service. You are not permitted to assign or transfer your Account to another person or business. When accessing or using the Services, you undertake to follow all applicable laws, and you may only access or use the Services for legitimate purposes. In some cases, you may be asked to provide proof of identity or another method of identity verification in order to access or use the Services, and you agree that if you refuse to provide proof of identity or another method of identity verification, you may be denied access to or use of the Services.
Messaging via text
By registering for an Account, you agree that the Services may send you text (SMS) messages as part of the normal course of business of your usage of the Services. You may opt out of receiving text (SMS) messages from Inch-Online Construction Works at any time by alerting Inch-Online Construction Works of your desire to do so. You understand that opting out of receiving text (SMS) messages may have an effect on your use of the Services.
Promotional Codes
In its sole discretion, Inch-Online Construction Works may create promotional codes that can be redeemed for Account credit or other features or benefits related to the Services and/or the services of an associate, subject to any additional terms that Inch-Online Construction Works establishes on a per promotional code basis ("Promo Codes").
Please read the applicable regulations as well as our Privacy Policy before participating in any Promotions. If the rules of a Promotion contradict with these Terms, the rules of the Promotion will take precedence.
User-Generated Content
Inch-Online Construction Works may, at its sole discretion, permit you to submit, upload, publish, or otherwise make available to Inch-Online Construction Works through the Services textual, audio, and/or visual content and information, including commentary and feedback related to the Services, the initiation of support requests, and the submission of entries for competitions and promotions, from time to time ("User Content"). Any User Content you provide stays your own.
You grant us the right and permission to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and via the Service by posting Content to the Service. You retain all rights to any and all Content you upload, post, or display on or through the Service, and You are responsible for safeguarding those rights. You agree that this licence includes the right for us to make your Content available to other Service users, who may likewise use your Content in accordance with these Terms.
PAYMENT
You realise that using the Services may result in charges to you for services provided by an associate ("Charges"). The associate will be charged for his or her visit.
For the Services supplied by Inch-Online Construction Works to you, Inch-Online Construction Works will charge you a convenience fee ("Fee"). The Fee may be charged to you when you book services on the platform or after the service is completed.
Where required by law, such charges and fees will include applicable taxes. The charges and fees you pay are final and non-refundable.
All Charges and Fees are due immediately, and payment will be completed by Inch-Online Construction Works using the selected payment method designated in your Account, following which Inch-Online Construction Works will issue you a receipt.
DISCLAIMERS; LIMITATION OF LIABILITY; INDEMNITY
Disclaimer
The Service is offered to You "As Is" and "As Available," with all flaws and deficiencies, and without any warranty of any kind. To the greatest extent permitted by applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as warranties that may arise out of course of dealing, course of performance, or otherwise.
Limitation of Liability
Regardless of any losses You may incur, the Inch-Online Construction Works and any of its suppliers' total liability under any provision of these Terms, and Your only recourse for all of the foregoing, shall be limited to the amount actually paid by You through the Service. To the greatest extent permitted by applicable law, neither the Company nor its suppliers shall be liable for any special, incidental, indirect, or consequential damages of any kind (including, but not limited to, damages for loss of profits, loss of data or other information, business interruption, personal injury, or loss of privacy) arising out of or in any way connected with the use or inability to use the Service, third-party software, and/or third-party hardware.
Indemnity
You agree to indemnify and hold Inch-Online Construction Works and its affiliates, as well as their officers, directors, employees, and agents, harmless from and against any and all claims, demands, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with: (i) your use of the Services or services or goods obtained through your use of the services; (ii) your breach or violation of any of these Terms; (iii) Inch-Online Construction Works use of your User Content; or (iv) Losses.
Arbitration, Governing Law
If and to the extent that Inch-Online Construction Works directly caused or contributed to any such Losses, your obligation under this section will be reduced correspondingly.
There are a number of methods available to you to resolve any dispute, conflict, claim, or controversy arising out of or in connection with the Services or these Terms, including those relating to their validity, construction, or enforceability, or with the services provided by an Associate (any "Dispute").
In relation to applicable consumer laws, including the non-excludable elements of the relevant Consumer Law legislation, you may have the right to file a complaint to fair trading or consumer low organisations.

Grievance Officer
The grievance officer of Inch-Online Construction Works shall be the consumer protection officer for the purposes of the Consumer Protection Act, 2019 and the rules and regulations enacted thereunder.
